9. Delivery
Before formalizing the order, you must select the delivery method that best suits your needs. Unless agreed otherwise, we will send the order consisting of the product(s) listed in each Dispatch Confirmation without undue delay and no later than 30 calendar days from the date of the Order Confirmation.
Please note that there may be circumstances arising from product customization or unforeseen/extraordinary events that may affect the delivery date.
During periods of high demand, such as specific promotional or seasonal campaigns, or when order volumes are higher than usual, delivery times may exceptionally be extended.
If for any reason we are unable to meet the delivery date, we will inform you as soon as possible and give you the option to proceed with the purchase by setting a new delivery date, replace the items with alternatives, or cancel the order with a full refund of the price paid. Please note that, in any case, we do not make home deliveries on Saturdays or Sundays.
For the purposes of these Terms, "delivery" shall be understood to have taken place, or the order to have been "delivered", at the moment you or a third party designated by you acquires physical possession of the goods, which will be evidenced by the signature of receipt of the order at the agreed delivery address.
10. Inability to Deliver
Contracts concluded electronically shall produce all the legal effects provided by law when consent and the other requirements necessary for their validity are met.
If it is impossible for us to deliver your order, the shipping company will try to find a safe place to leave it. If a safe place cannot be found, your order will be returned to our warehouse. We will also leave a note explaining where your order is and how to arrange for the courier to deliver it. If you will not be at the delivery location at the agreed time, please contact the assigned courier company directly.
In the event that the order has not been delivered for reasons not attributable to us, we will contact you. If, after 14 calendar days from the date the item was made available to you, it has not been collected or you have refused to receive it, it will be deemed abandoned, and the USER shall have no right to a refund of the price paid. The company reserves the right to pass on to the USER any costs incurred as a result of the failure to receive the parcel.
Under no circumstances shall the USER's failure to accept or collect the parcel be considered a valid way of exercising their right of withdrawal.
11. In-Store Pickup
If you choose the In-Store Pickup option, your order can be collected at one of our physical stores. Once the order has been prepared, we will contact you to let you know that it is ready for collection. You may collect the order in person (presenting your order number, name, and official ID) or designate someone else to collect it on your behalf, in which case they must present the order number along with their own official ID (i.e., the ID of the designated person).
If you make a purchase using the In-Store Pickup service, these Terms shall apply equally to you, without prejudice to any other applicable legal regulations.
12. Pre-Order Items
When purchasing items on pre-order, they will be delivered to the address selected by you within the timeframes indicated on our website.
Once the item becomes available, its shipment will be subject to the delivery terms set out in Sections 8 and 9, and the USER will be notified accordingly.
In the case of mixed orders consisting of regular-stock items and pre-order items ("Combined Orders"), even if all items are paid for in the same order, they may be shipped separately and delivered within different timeframes.
Once the pre-order items have been prepared, we will contact you to inform you that they are being shipped ("Dispatch Confirmation").
You have the right to withdraw from the contract within 14 calendar days without giving any reason. In the case of Combined Orders, the withdrawal period will expire after 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the last of the goods.
If you purchase a pre-order product, all provisions contained in these Terms shall apply equally to your order.
13. Transfer of Risk and Ownership
The risks associated with the products shall be borne by you from the moment of delivery.
You will acquire ownership of the products when we receive full payment of all amounts due in relation to them, including shipping charges, or upon delivery (as defined in Section 9 above), if delivery takes place at a later time.
14. Price and Payment
The prices displayed on the website include applicable taxes but exclude shipping costs, which will be added to the total amount in the shopping cart.
Prices may change at any time and are not exempt from typographical errors; however, except as set out above, possible changes will not affect orders for which we have already sent a Dispatch Confirmation.
Once you have selected all the items you wish to purchase, they will be added to your cart, and the next step will be to process the order and make payment. To do so, you must follow the steps of the purchase process, completing or checking the information requested at each step. By clicking "Confirm order", you confirm that the card, account, or payment method used belongs to you or that you are the legitimate holder or user. Orders placed with fraudulent payment methods, or those our team determines may be fraudulent, will be cancelled until their legitimacy is clarified.
To minimize the risk of unauthorized access, your payment details are encrypted. Card payments are subject to validation checks and authorization by the card issuer. If the issuer fails to authorize payment, we will not be liable for any delay or non-delivery, and we will be unable to formalize any contract with you.
15. Guest Checkout
This website also allows purchases through the guest checkout functionality. Under this purchasing mode, you will only be asked for the essential details required to process your order.
16. Value Added Tax (VAT) and Invoicing
For customers whose delivery address is within the European Union, all displayed prices include VAT; however, this tax will be deducted if shipping to an exempt territory.
In accordance with Article 68 of Spanish Law 37/1992, of December 28, on Value Added Tax, the delivery of items shall be deemed to take place within Spanish VAT territory if the delivery address is in Spanish territory, excluding the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be that legally in force at any given time depending on the specific item concerned.
For orders destined for the Canary Islands, Ceuta, and Melilla, or other territories outside mainland Spain, deliveries and displayed prices are exempt from VAT pursuant to Article 21 of Law 37/1992, without prejudice to the application of local taxes and customs duties in accordance with the regulations in force in each territory. Shipping companies may charge the customer administrative customs clearance fees, which are the sole responsibility of the customer and not of La Musa.
You expressly authorize us to issue your invoice in electronic format, which you will find available for download in your Account. If you require a paper invoice, you may request one by contacting La Musa through the contact channels available on our website.
17. Return Policy
Statutory Right of Withdrawal
Right of withdrawal
If you are contracting as a consumer and user, you have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire after 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquired physical possession of the goods, or in the event that the goods composing your order are delivered separately, after 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, acquired physical possession of the last of those goods.
To exercise the right of withdrawal, you must notify La Musa at Calle Peso de la Harina 19, 29007, Málaga (Spain), or via soporte.lamusainstrumentos.es, of your decision to withdraw from the contract through an unequivocal statement. To meet the withdrawal deadline, it is sufficient for your communication concerning your exercise of this right to be sent before the withdrawal period has expired. We also provide an optional return form accessible from the orders section of your user account.
Consequences of withdrawal
The consumer and user must return or deliver the goods to MAREMUSIC RBC, S.L., without undue delay and in any event no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline is met if you send back the goods before the period of 14 calendar days has expired.
The consumer and user shall bear the direct cost of returning the goods if they choose to use their own shipping method.
We will reimburse all payments received from you without undue delay and in any event no later than 14 calendar days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction. Notwithstanding the foregoing, we may withhold reimbursement until we have received the goods back and verified their perfect condition. You must return the products directly to any physical La Musa store in Spain, or request return collection/shipping through our website using our partner courier service.
Unless you return the goods directly to a La Musa store in Spain, you must bear the direct cost of returning the goods. If you use a shipping method organized by us, the following amounts will be deducted from your final refund to cover return shipping costs:
- €2.99 for returns from mainland Spain, Portugal, and the Balearic Islands.
- €9.99 for returns from the Canary Islands, Ceuta, and Melilla.
- €9.99 for returns from other European Union countries.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Common Provisions
You shall not have the right to withdraw from a contract for the supply of any of the following products:
- Customized or tailor-made items.
- Sealed CDs/DVDs that have been unsealed after delivery.
- Books.
- Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery, such as reeds or mouthpieces.
Your right to withdraw from the contract shall apply exclusively to products that are returned in the same condition in which you received them. No refund will be made if the product has been used beyond mere opening, if it is not in the same condition as when delivered, or if it has suffered any damage; therefore, please take care of the items while they are in your possession. Please return the item using or including all original packaging, instructions, and any accompanying documents.
You may return products at any La Musa physical store, by your own means, or through the return shipping service we provide.
In-store returns
You may return products to any physical La Musa store. In this case, you must visit the store and present the item(s) together with the order number included in the Dispatch Confirmation, which is also saved in your La Musa website account.
Returns via Post Office / courier drop-off
You must request the return through your website account, selecting the order and the item(s) you wish to return so that we can arrange for drop-off at a courier/post office point. If you no longer have the original packaging, you may return the item in different packaging, provided it securely protects the items and prevents loss or damage during transit. If you made your purchase as a guest, please contact us directly to request the return label. Once verified, you will receive an e-mail with a shipping label to attach to the parcel before dropping it off at the designated drop-off point. You will also receive detailed instructions.
The following amounts will be deducted from your final refund for return shipping costs, depending on the origin of the return:
- €2.99 for returns from mainland Spain, Portugal, and the Balearic Islands.
- €9.99 for returns from the Canary Islands, Ceuta, and Melilla.
- €9.99 for returns from other European Union countries.
If you choose not to return products using any of our available options, you will be responsible for the return shipping costs. Please note that if you decide to send the items back to us freight collect or cash on delivery, we are authorized to charge you for any expenses incurred.
Please note that, once delivery has taken place, if you exercise your right of withdrawal and organize the return shipping yourself without using our offered service, we cannot assume the risk of loss or damage to the return parcel for reasons not attributable to La Musa.
After inspecting the parcel at our facilities, we will inform you whether you are entitled to a refund of the amounts paid. The refund will be processed as soon as possible and, in any event, within 14 days from the date we receive the returned goods.
If we receive an item outside the stipulated period, in poor condition, containing incorrect contents, or which otherwise does not meet the requirements for withdrawal, you will not be entitled to a refund. We will contact you, and if after two (2) months from notifying you that the item is at your disposal you have not collected it or refuse to receive it, we will not be responsible for it and it will be deemed abandoned. We reserve the right to pass on to you any costs incurred if it is possible to arrange the return shipment to your attention.
Please remember that you are responsible for the contents of the return parcel when using any return option offered by La Musa. In the event of an error in the contents of the return parcel not attributable to La Musa, we reserve the right to charge you any costs incurred to redirect the incorrect parcel back to you.
All statutory rights recognized by current legislation remain unaffected.
Returns from the Canary Islands, Ceuta, Melilla, and Other Non-Mainland Territories
If you wish to return a product delivered to the Canary Islands, Ceuta, Melilla, or any territory outside mainland Spain, you may do so in person at any La Musa physical store in accordance with this clause. If this is not possible, you must contact us beforehand to coordinate return shipping with La Musa. Please note that shipments originating outside the European Union incur customs duties and import fees, which will be deducted from your total refund amount.
Returns of Defective Products
If you consider that, at the time of delivery, the product does not conform to the contract, you must contact us immediately (and no later than within 7 calendar days) through our contact channels, providing details of the product and the damage sustained, and we will instruct you on how to proceed.
Please remember that if, at the time of delivery by the shipping company, the parcel or packaging is visibly damaged or tampered with, you must refuse delivery and not accept it. In such cases, please contact us immediately so we can provide a solution, such as sending a replacement order or issuing a refund.
If you accept delivery and the product is defective, you may return it at any La Musa physical store or by dropping it off at a designated collection point when requesting the return.
We will carefully inspect the returned product and notify you by e-mail within a reasonable period whether a refund or replacement (where applicable) is approved. The refund or replacement will be processed as soon as possible and, in any case, within 14 days of the date we send an e-mail confirming that a refund or replacement of the non-conforming item is approved.
The amounts paid for products returned due to a genuine flaw or defect will be refunded in full, including the initial shipping costs incurred to deliver the item and any costs you incurred to return it to La Musa. The refund will be made using the same payment method used for the original purchase.
All statutory rights recognized by current legislation remain unaffected.
Order Cancellation Due to Delivery Rejection
If, while an order is already in transit, you decide to reject or cancel it, the parcel will be returned to La Musa. In such cases, the refund will be processed as soon as possible and, in any event, within 14 days from the date we receive the goods back at our warehouse.
If the order was destined for a European Union territory, a fixed fee of €30.00 will be deducted from your refund to cover return logistics and processing costs. If the order was destined for a territory outside the EU that may generate customs duties and additional import charges, La Musa will be required to pay those fees to retrieve the parcel; these customs fees will be passed on to the customer and deducted in full from the refund amount, in addition to the €30.00 fee for return logistics, refund processing, and customs clearance management.
18. Warranties
If you contract as a consumer and user, you are entitled to free corrective remedies in the event of any lack of conformity of the goods. We provide warranties on all products sold through this website under the legally established terms for each category, being liable for any lack of conformity that becomes apparent within three years from the date of delivery.
Products are deemed to conform to the contract provided that: (i) they match our description and possess the qualities presented on this website, (ii) they are suitable for the usual purposes for which goods of the same type are used, and (iii) they show the quality and performance normally expected of goods of the same type. If any product fails to conform to the contract, you must inform us following the procedure set out in Section 17 above through any of our dedicated communication channels.
The products we sell—especially handcrafted instruments or limited-edition series—often display natural characteristics inherent to the materials used in their manufacture. Such characteristics, including variations in grain, texture, or finish, shall not be considered defects or flaws. On the contrary, their presence should be expected and appreciated as part of the individual appearance and character of the musical instrument.
Our commercial warranty does not affect any statutory rights recognized by current legislation.
19. Liability and Disclaimer
Unless expressly provided otherwise in these Terms, our liability regarding any product purchased on our website shall be strictly limited to the purchase price of that product.
However, and unless statutory provisions dictate otherwise, we accept no liability for the following losses, regardless of their origin:
